1. Acceptance of Terms

By accessing or using any NextIQ Solutions product or service — including the FoundNow platform, the 4Mo mobile application, or this website — you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, you may not use our services.

These Terms apply to all users, including school administrators, parents, students (where applicable), and consumers. Where specific terms apply to a particular product, they are noted below.

2. Our Services

NextIQ Solutions (Pty) Ltd provides the following services:

FoundNow: A QR-based lost property management platform for schools, including a School Admin App, a Parent App, and associated smart label products.
4Mo: A real-time nightlife discovery mobile application that enables users to rate and discover venues.
This website: An informational website at nextiq.co.za and associated subdomains.

We reserve the right to modify, suspend, or discontinue any service or feature at any time with reasonable notice. We will not be liable to you for any modification, suspension, or discontinuance of services.

3. Eligibility

You must be at least 18 years old to create an account on any NextIQ platform.
4Mo is intended for adults aged 18 and over.
FoundNow school accounts must be registered by an authorised representative of the school.
FoundNow parent accounts are for use by the parent or legal guardian of a registered learner.

4. User Accounts

To use most features of our products, you will need to create an account. You agree to:

Provide accurate and complete information when registering.
Keep your account credentials secure and not share them with others.
Notify us immediately if you suspect unauthorised access to your account.
Be responsible for all activity that occurs under your account.

We reserve the right to suspend or terminate accounts that violate these Terms or that appear to be used fraudulently or abusively.

5. Acceptable Use

You agree not to use our services to:

Violate any applicable law or regulation, including POPIA.
Harass, abuse, or harm other users.
Submit false, misleading, or fraudulent information (including fake venue ratings on 4Mo).
Attempt to gain unauthorised access to our systems or other users' accounts.
Use automated tools to scrape, crawl, or extract data from our platforms without permission.
Interfere with the operation or availability of our services.
Use FoundNow for any purpose other than legitimate school lost property management.

6. Intellectual Property

All content, software, trademarks, and intellectual property on our platforms — including the FoundNow and 4Mo brand names, logos, app interfaces, and website content — are owned by NextIQ Solutions (Pty) Ltd or its licensors.

You may not copy, distribute, modify, create derivative works from, or commercially exploit any of our intellectual property without our prior written consent.

7. FoundNow — Specific Terms

The following additional terms apply to schools and parents using FoundNow:

Schools are responsible for ensuring that staff use the Admin App in accordance with the school's own policies and POPIA obligations.
Smart labels remain the property of the purchaser. NextIQ is not responsible for label quality issues beyond the warranty provided at time of purchase.
FoundNow is a tool to facilitate lost property management and does not guarantee the return of any item. NextIQ accepts no liability for items that are not found, not scanned, or not collected.
Schools agree not to use FoundNow data for purposes other than lost property management.

8. 4Mo — Specific Terms

The following additional terms apply to 4Mo users:

Ratings and reviews submitted on 4Mo must be based on genuine, first-hand experience at the venue.
You may not submit ratings on behalf of a venue, for payment, or to deliberately damage a venue's reputation without factual basis.
Venue owners who claim and manage a listing agree to provide accurate information and not to manipulate ratings.
4Mo ratings are used for informational purposes. NextIQ does not endorse any venue and is not responsible for the quality, safety, or conduct of any venue listed on the platform.

9. Limitation of Liability

To the maximum extent permitted by South African law, NextIQ Solutions (Pty) Ltd shall not be liable for:

Any indirect, incidental, special, or consequential damages arising from your use of our services.
Loss of data, loss of revenue, or business interruption.
Any act or omission of a third party, including venue operators or schools.

Our total liability to you for any claim arising from these Terms or your use of our services shall not exceed the amount you paid to us in the 12 months preceding the claim.

10. Disclaimers

Our services are provided "as is" without warranties of any kind, express or implied. We do not warrant that our services will be uninterrupted, error-free, or completely secure. You use our services at your own risk.

11. Governing Law

These Terms are governed by the laws of the Republic of South Africa. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of South Africa.

12. Changes to These Terms

We may update these Terms from time to time. We will notify users of material changes via the app or by email at least 14 days before the changes take effect. Continued use of our services after that date constitutes acceptance of the updated Terms.
